New figures produced by the Minstry of Justice show that there has been a significant shift in the number of landlords choosing to take the Section 21 accelerated possession route instead of using the Section 8 Notice – even where there are arrears outstanding.
In the last quarter of 2015 nearly 28,500 orders for possession were successfully obtained. Unfortunately however, a staggering 20% of Section 21 accelerated possession claims fail due to the paperwork not being completed correctly.
The Section 21 process can be a minefield with even simple mistakes causing a claim for possession to fail:
- Has the right form been completed with the correct information
- Has the correct expiry date been entered?
- Has the deposit been registered correctly and the necessary documentation provided before the service of the notice?
